visibility of the factbox (or part control in page)

I have a problem controling the visibility of the factbox (or part control in pages).

problem description:

I have two part controls in a page (two part controls conencted to two different pages). Depending on certain condition i would like to control the visibility by creating a variable, (IncludeInDataset = true), assign the variable to visibility property of the part controls. But part controls always show up in pages irrespective of the value in variable. Am i missing something? OR does dynamic visibility work with part controls ?

please help if you have any solution.
